K-Electric tariff case

KARACHI: The Sindh High Court (SHC) has suspended the disputed tariff orders and related notifications concerning K-Electric and issued notices to the National Electric Power Regulatory Authority (NEPRA) and other parties. The court has fixed the matter for hearing on October 15, 2026.

Court Suspends Tariff Orders

The SHC passed interim orders after K-Electric challenged decisions of the NEPRA Appellate Tribunal dated September 23, 2026, along with NEPRA’s earlier tariff review determinations and subsequent notifications.

The court admitted the appeals and temporarily suspended the challenged orders and notifications pending the outcome of the case.

K-Electric Challenges NEPRA Decisions

During the hearing, K-Electric’s counsel argued that NEPRA has the authority to review tariff decisions but cannot use the review process to determine the tariff afresh.

The company has also challenged NEPRA’s review determinations dated October 20, 2025, as well as related notifications issued in September 2026.

Multi-Year Tariff Under Dispute

The case concerns K-Electric’s Multi-Year Tariff (MYT) for FY2024 to FY2030.

According to K-Electric, the disputed review decisions had a substantial financial impact on the company’s tariff framework. The company has maintained that the resulting tariff structure was not financially sustainable.

Earlier Tariff Determinations

During the proceedings, the court was informed that NEPRA had determined K-Electric’s supply tariff on May 27, 2025, while the generation tariff was determined on October 22, 2024.

The distribution and transmission tariff was determined on May 23, 2025. K-Electric’s counsel said the company’s tariff is determined by NEPRA and reviewed under the applicable multi-year tariff framework.

Hearing Adjourned Until October 15

The Sindh High Court has sought responses from NEPRA and other parties and adjourned further proceedings until October 15.

Separately, NEPRA has notified an additional Rs1.11 per unit fuel cost adjustment for August 2026, which will be reflected in October electricity bills for K-Electric and other applicable consumers, excluding certain categories such as lifeline consumers.
