Court Issues Interim Order
Justice Muhammad Azam Khan issued the interim order while hearing a petition filed by citizen Malik Mumtaz Ali Khan. The court issued notices to the CDA and directed the authority to submit para-wise comments and a report before the next hearing.
Dispute Over House in Village Koral
The case concerns the petitioner’s house located in Village Koral, Highway Street. According to the petitioner, the CDA issued a notice on October 1, 2026, asking him to remove alleged encroachments within three days.
The CDA reportedly identified a 35-foot-7-inch portion of the property as falling within the right of way.
Citizen Challenges CDA Notice
The petitioner told the court that he had purchased the property around 20 years ago and constructed the building over approximately 15 years at considerable expense.
He further said that when the service road was widened around 10 years ago, approximately 30 feet had been left between his house and the road.
Court Restrains Demolition
The petitioner argued that if additional land was required for future road widening, the authorities should acquire it according to the law.
After hearing the petition, the IHC restrained the CDA from demolishing the building or taking coercive action against the citizen while the matter is being considered by the court.

CDA Asked to Submit Report
The court has sought the CDA’s para-wise comments and a detailed report before the next hearing. The proceedings will determine the authority’s position regarding the disputed portion of the property and the demolition notice.
The order comes as the CDA continues enforcement operations against encroachments and unauthorised construction across Islamabad.
