Gohar Challenges Emergency and Governor’s Rule in KP High Court

Gohar challenges governor’s rule in KP

PESHAWAR, October 14, 2026: Pakistan Tehreek-e-Insaf (PTI) Chairman Barrister Gohar Ali Khan has filed a constitutional petition in the Peshawar High Court (PHC), challenging the imposition of emergency and governor’s rule in Khyber Pakhtunkhwa (KP).

The petition asks the court to declare the measures unconstitutional and set aside the October 11 proclamation. The party is also seeking the restoration of the province’s elected government.

PTI Seeks to Declare Emergency Proclamation Unconstitutional

The petition was submitted by Advocate Shah Faisal Ilyas on behalf of Barrister Gohar. It challenges the legality of the emergency proclamation and asks the court to examine the basis on which the federal government imposed the measures.

The petition describes the proclamation as unconstitutional and alleges that it was issued without sufficient objective grounds. These are the petitioner’s legal claims, and the court has yet to determine the matter.

The case has been filed under Article 199 of Pakistan’s Constitution, which deals with the constitutional jurisdiction of high courts.

Federation and KP Officials Named as Respondents

The petition names the Federation of Pakistan, represented through relevant federal secretaries, as well as the Khyber Pakhtunkhwa government and Governor Faisal Karim Kundi.

Other respondents include the speaker of the KP Assembly and the secretary of the provincial Home and Tribal Affairs Department. Former chief minister Sohail Afridi has also been included as a pro forma respondent.

Emergency and Governor’s Rule Imposed on October 11

The federal government imposed emergency and governor’s rule in Khyber Pakhtunkhwa on October 11, following growing political tensions and disagreements over the province’s security situation.

The federal government cited concerns about counterterrorism efforts and alleged disengagement by the provincial administration. PTI, however, has rejected the decision, arguing that it undermines the province’s elected government and constitutional autonomy.

PTI Turns to the Courts to Challenge the Decision

Barrister Gohar and other PTI leaders have said the party will pursue legal and constitutional avenues to oppose the measures. The petition represents the party’s latest effort to challenge the federal government’s decision through the judiciary.

The court’s review will determine whether the challenged measures comply with constitutional requirements. No final ruling on Gohar’s petition was reported in the available coverage at the time of filing.
